TERMS & CONDITIONS

  1. Device Financing Agreement: The customer agrees to avail financing for a specific smartphone model from Kistpay Private Limited at an agreed price on an installment basis.
  2. Documentation: The customer must provide all necessary documents as requested by Kistpay Private Limited for the processing of their financing application.
  3. Limitation on Multiple Financing: The customer can avail only one smartphone from Kistpay at a time until the previous payments are completed and the financing application is closed. Afterward, the customer can apply for further financing.
  4. Accuracy of Information: The customer declares that all the information provided in the application form is accurate and complete to the best of their knowledge.
  5. Authorization and Verification: The customer authorizes Kistpay Private Limited or its appointed agents to contact and use their provided information for verification purposes during the application process. This includes residence, work, and reference details, as well as any necessary verification for device financing, protected by Device Lock Technology.
  6. Device Lock Technology: Kistpay utilizes Device Lock Technology to lock the smartphone device in the event of a customer's failure to pay installments by the due date mentioned in the payment schedule.
  7. Credit Verification: The customer authorizes Kistpay to obtain and verify their information from credit bureaus, agents, banks, financial institutions, companies, and markets for credit verification purposes during the application process and throughout the financing period.
  8. The customer explicitly consents to the sharing of their information with third parties for the purpose of providing value-added services or conducting data verification related to device financing.
  9. Application Acceptance/Rejection: Kistpay Private Limited reserves the right to accept or reject smartphone installment applications at their discretion.
  10. Ownership and Device Lock: The customer acknowledges that the financed device remains the property of Kistpay Private Limited until full payment is received and the device's IMEI (International Mobile Equipment Identity Number) is released from the Device Lock Application.
  11. Third-party Apps and Device Security: The customer agrees to comply with all applicable guidelines and restrictions particularly regarding the installation of unsecured third-party apps, including open-source applications/SDKs, as defined by relevant app store policies & regulations. The customer also acknowledges for anti-theft service & device security protocols, the device location services to remain enabled throughout the financing period.
  12. Advance Payment: Upon approval of the financing application, the customer is required to make a down payment according to the agreed payment plan to complete the financing process.
  13. Identification Proof: The customer must provide their original CNIC (Computerized National Identity Card) along with a copy for identification verification during product delivery.
  14. Payment Methods: The advance payment and monthly installments must be made through the designated payment methods specified by Kistpay Private Limited.
  15. Product Availability and Pricing: Product delivery is subject to stock availability, and prices are subject to change without prior notice until the sale of the smartphones. If the desired color is unavailable, the customer must choose from the available color options.
  16. Financing Tenure: The financing tenure is determined by the financing payment schedule agreed upon.
  17. Default Consequences: In the event of default on installment payments, the smartphone will be declared "Stolen," and Kistpay reserves the right to take action, including blocking the mobile phone across all cellular networks.
  18. Kistpay Anti-theft Service: The customer agrees to register and subscribe to Kistpay Anti-theft, a smartphone security and tracking service that blocks a handset from registering on a cellular network if it is lost or stolen.
  19. Compulsory Takaful Insurance: The customer agrees to avail smartphone Takaful insurance through Kistpay. The insurance payment will be collected in full along with the down payment.
  20. Insurance Claim Settlement: In the event of loss or theft, insurance claims will be settled according to the policy of the Takaful insurance company to Kistpay Pvt. Ltd. Kistpay will then settle any outstanding dues before refunding the remaining amount to the customer.
  21. Price Changes: Prices of smartphones are subject to change without prior notice.
  22. Warranty Coverage: Warranty coverage is provided as per the terms and conditions mentioned on the warranty card accompanying the smartphone.
  23. Device Lock for Late Payments: The financed device will be locked via the device lock program/feature and restricted from registering on a cellular network if installment payments are not made on time. The customer has a two-day grace period to clear the payment, after which the device will be locked. Once the installment(s) are paid, the device will be unlocked.
  24. Default Consequences and Legal Action: Failure to repay the financing/installments may result in the customer's name being reported to credit bureaus, and Kistpay Private Limited reserves the right to initiate legal action. Payments can be made through the Kistpay App even if the phone is locked.
  25. Device Brick Responsibility: Should the customer render the device inoperative (bricked) by engaging in activities such as trying to circumvent the Kistpay App through rooting the device or sabotage, the customer assumes accountability for any resultant damage to the device. Additionally, if the customer sells or endeavors to sell the financed device owned by Kistpay before the installment plan reaches maturity or is fully paid off, the outstanding financing amount will become immediately due to Kistpay. Furthermore, the customer will no longer qualify for additional financing, and Kistpay reserves the right to pursue legal action against the customer and place the customer on a financing blacklist.
  26. Device Loss, Theft, or Damage: If the device is stolen, lost, or irreparably damaged during the financing term, the customer remains liable to pay the remaining installments as per the payment schedule.
  27. Warranty and Service Centers: Warranty terms and coverage are as mentioned on the warranty card, and all warranty claims must be made at authorized service centers.
  28. Complaints and Installment Obligations: Any complaint about the quality of the financed smartphone or services rendered by the supplier does not exempt the customer from the obligation to continue paying the monthly installments to Kistpay Private Limited.
  29. No Warranty for Defects: Kistpay Private Limited holds no responsibility for any defects in the smartphones sold and does not provide any warranty, whether expressed or implied, regarding their condition, suitability, or efficacy, as allowed by law or custom.
  30. Refund Policy: Refunds are subject to certain conditions. The service fee and processing fee, if charged initially, will be deducted from the refunded amount. The smartphone must be returned within three working days in its original sealed condition with the package seal intact. Kistpay reserves the right to reject refund requests, and its decision will be final and binding.
  31. Refund Processing Time: If a refund is approved, the amount (after deductions, if applicable) will be processed into the customer's designated bank account or digital wallet within 15 working days from the date of refund request initiation.
  32. Early Payment: The customer can choose to pay off the full financing amount at any point in time.
  33. Family Affiliation: The customer confirms that, as of today, none of their immediate relatives or family members are employed or associated with Kistpay Private Limited. They agree to provide details if any family members or relatives become associated with Kistpay Private Limited.

By agreeing to the terms and conditions, I, the customer, consents to to avail a financed smartphone device from Kistpay Private Limited. I understand & accept the obligations, including device lock, security protocols, credit verification, and authorize Kistpay to proceed with my application.
